Definition of Iddah Period

Women who are divorced or widowed must undergo an iddah period. Furthermore, some scholars have different interpretations of the iddah period.

Abdul Qadir Mansyur states, ‘Women who are divorced or widowed must observe the iddah period.’ Mansyur then determined the end of the iddah period by childbirth, menstruation, chastity, or the number of months.

Furthermore, the Hanafis explain that iddah is a waiting period for a woman to confirm her marital status which is material, such as checking for pregnancy or to protect the husband’s honor.

The Malikiyah scholars stipulated that a divorced or widowed woman must undergo an iddah period, which is a period during which she may not marry. The Compilation of Islamic Law in Indonesia defines iddah as a waiting period. A final court decision or the death of the husband marks the beginning of the iddah period.

Iddah period for deceased husband

Based on Article 153 paragraph (2) KHI, the iddah period for a death divorce or the iddah period for a deceased husband is 130 days.

Then, there is a view that states that the prohibition during the iddah period of a deceased husband is not to leave the house.

In addition, there are also those who say that during the iddah period, women are not allowed to leave the house or put on makeup. Some say that the iddah period is 40 days for a deceased husband, others say 4 months and 10 days, and so on.

The Compilation of Islamic Law (KHI) prohibits a woman from remarrying during the iddah period. If the marriage is still held, the authorities can cancel it according to Article 71 letter c KHI.
