Recently, celebrity and businessman Rachel Vennya’s ex-husband, Niko Al Hakim aka Okin, suddenly became the talk of netizens in the digital world because he was suspected of plagiarizing other people’s culinary businesses. It is known that Okin has opened a culinary business with a noodle bar concept in Yogyakarta called GoKari. However, this is not free from controversy, because there are allegations that his business plagiarized the idea of the Seporsi Mie Kari restaurant that had been operating in the Alam Sutera area, South Tangerang. So the question is, how come? How was the allegation of plagiarism raised by the owner of Seporsi Mie Kari restaurant against Okin? Check out the full chronology below!

How is the Business Plagiarism Alleged?

The owner of Seporsi Mie Kari publicly expressed his concerns through his Twitter account. In the upload, the owner who uses the @m0lylim account expressed his disappointment when he found out that his business was duplicated by another restaurant located in Jogja. “Want to vent. So there is a duplicate of my and my husband’s F&B business, Seporsi Mie Kari which was originally in Alam Sutera, doi duplicate open in Jogja, called GoKari,” tweeted the Twitter account which was re-uploaded by Twitter @jogmfs, Wednesday (28/6/2023). The tweet did not mention Okin’s name, but he is known to be the owner of GoKari. Not only limited to the concept and menu, but the interior design, sticker details, and fonts used in the new restaurant look exactly the same as Seporsi Mie Kari, which she founded with her husband. Suddenly, the tweet from the owner of Seporsi Mie Kari went viral and caused a response from netizens. Many of them agreed that GoKari was duplicating because there were so many similar aspects.

The Importance of Official Registration in Protecting IPRs

Official registration of brands, logos, and designs with the DJKI of the Ministry of Law and Human Rights plays an important role in protecting intellectual property rights. The plagiarism case involving Okin as the owner of GoKari and Seporsi Mie Kari is a valuable lesson on the importance of such official IPR registration. Official registration of brands, logos, and designs with the DGKI provides strong legal protection to the intellectual property owned by a business. By having a registered brand, a business owner can protect its identity from plagiarism or unauthorized use by other parties. A registered trademark also provides a competitive advantage, builds a strong brand image, and makes it easier for consumers to recognize the products offered. Apart from brands, logo and design registration is also important to protect the distinctive elements of the business. A registered logo provides security against risk-authorized use and ensures that unique design elements are not used by other businesses. Similarly, registration of a restaurant’s interior design can provide protection to designs that have been specially created to create a unique ambience and distinguish the business from others. In the case of Okin and Seporsi Mie Kari, the presence of official brand, logo and interior design registrations can strengthen the argument of the owner of Seporsi Mie Kari in defending its intellectual property rights. If there is an official registration, it can be strong evidence that they are the original owner and have exclusive rights to the brand, logo, and design that they have created. Furthermore, if in a legal dispute, this official registration can be a deciding factor in favor of the owner who feels aggrieved due to business plagiarism.
