Aside from mudik (homecoming), one of the most anticipated things during Ramadan is the THR (Tunjangan Hari Raya). As employers, of course, we want to provide the best and proper for our workers. And, remember, there are sanctions that will be imposed on employers when violating regulations related to THR. Launching Gajimu.com, the amount of THR as stipulated in article 3 paragraph 1 of the Minister of Manpower and Transmigration Regulation No. 6 of 2016 concerning Religious Holiday Allowances for Laborers / Workers in Companies (Permenaker 6/2016) is stipulated as follows:

  • Workers who have 12 (twelve) months of continuous service or more, are given 1 (one) month’s wage, and
  • Workers who have a continuous service period of 1 (one) month but less than 12 (twelve) months, are given proportionally according to the length of service with the calculation: length of service/12 x 1 (one) month wage.

However, Permenaker 6/2016 also emphasizes that if the company has a work agreement, company regulation (PP), orCollective Labor Agreement (PKB) that contains provisions for the amount of THR greater than the provision of 1 (one) month’s wage, then the THR that is greater in amount applies. Meanwhile, to calculate 1 (one) month’s wage for daily workers is as follows:

  • Workers who have a work period of 12 (twelve) months or more, 1 (one) month’s wages are calculated based on the average wages received in the last 12 (twelve) months before the religious holiday.
  • Workers who have had a working period of less than 12 (twelve) months, 1 (one) month’s wages are calculated based on the average wages received each month during the working period.

 

THR Granting Period

For THR payments, employers should not be late because the government confirms that the 2022 THR is regulated in the Minister of Manpower Circular Letter Number M/1/HK.04/IV/2022 issued on April 6, 2022. Minister of Manpower Ida Fauziyah said that the THR should be given at the latest seven (7) days before Eid.

Sanctions

Employers’ non-compliance in paying THR, according to Article 78 of Government Regulation (PP) Number 36 of 2021 concerning Wages, may be subject to administrative sanctions. In the form of written warnings, restrictions on business activities, temporary suspension of part or all of the production equipment and suspension of business activities.
