Giving hampers or parcels to your closest family and relatives is one of the traditions that is always done to celebrate Eid al-Fitr. Usually, Eid hampers are identical to pastries such as nastar, tongue cat, kastengel, and snow princess. Along with the times, a variety of foods ranging from pudding, brownies, lasagna to donuts are now also used as Eid hampers. The vast market and high profit prospects in the Eid parcel business make many people interested and glance at this business. However, to open a hampers business in the form of food, there are several permits that must be fulfilled. What are the permits in question? Check out the following Legal Contract explanation.

Online Business License

If you choose to sell online through your own website or e-commerce such as tokopedia or shopee, then the first permit that you must take care of is an online business license. This is because business actors who carry out Trading Through Electronic Systems (PMSE) business activities are required to have a business license. This provision is further regulated in PP No. 80 of 2019 concerning PMSE. Making an online business license is submitted to the Ministry of Trade through an electronically integrated business licensing system or Online Single Submission (OSS).

Micro and Small Business License

If you decide to sell hampers offline, you can apply for a Micro Small Business Permit (IUMK). The Micro and Small Business Permit is a legality mark in the form of a business license given to micro and small-scale business actors. Business actors can apply for IUMK offline by coming to the sub-district office where the business is located or online through the OSS page.

Home Industry Food Permit

Hampers cookies are a type of food processed from flour. For KH Pals who do their own production on a small or household scale, KH Pals also need to take care of the Home Industry Food Permit or what is known as SPP IRT. SPP-IRT is a written guarantee given by the Regent/Mayor to IRTP-produced food in their working area that has fulfilled the requirements for granting SPP-IRT in the context of circulation of IRTP-produced food. Thus, SPP-IRT functions as a distribution permit for cookies sold in hampers. Since SPP-IRT is issued by the local government, business actors can apply for SPP-IRT through the PTSP service in the area where the business is located. To obtain SPP IRT, the business actors need to fulfill certain requirements, including:

    • Have a Food Safety Counseling certificate.
    • The results of the inspection of food production facilities for IRTP production meet the requirements.
    • Food labels comply with the provisions of laws and regulations.

For information, SPP IRT is valid for 5 years so that business actors do not need to apply for SPP IRT again when they want to do a cookie hamper business for the following year’s Eid.

Halal certificate

Halal Certificate is a recognition of the halalness of a product issued by the Halal Product Guarantee Agency based on a written halal fatwa issued by the Indonesian Ulema Council. Article 4 of Law No. 33 of 2014 concerning Halal Product Guarantee states that products that enter, circulate, and are traded in the territory of Indonesia must be halal certified. Recently, in order to support small-scale business actors, the government stated that halal certification will be free of charge for micro and small businesses. This can certainly be utilized by KH Pals who want to start a Lebaran hampers business but are not yet large-scale. To obtain this facility, business actors must fulfill several requirements, one of which is IUMK. To obtain a halal certificate, business actors can register through the Provincial LPPOM MUI website – MUI Online Halal Certification Service. Business actors who have obtained a halal certificate are required to:

    • Include halal labels on products that have received halal certificates.
    • Maintain the halalness of products that have obtained halal certificates.
    • Separating the location, place and slaughter, processing equipment, storage, packaging, distribution, sale and presentation between halal and non-halal products.
    • Renew the halal certificate if it expires.
    • Report changes in ingredient composition to BPJPH.
