Menurut Pasal 36 UU MIG, permohonan perpanjangan disetujui apabila:

Time Limit for Registered Trademark Protection

Registered trademarks receive legal protection for a period of 10 (ten) years from the date of acceptance and the period can be extended for the same period.

The purpose of setting the time limit for registered trademark protection for 10 years and can be extended is to ensure that the registered trademark is actually used on the goods/services and the goods/services are still produced and/or traded.

Application for Trademark Renewal

Application for the extension of trademark protection can be made at the time of 6 months before the expiration of the term of protection (6 months before the due date of the Trademark protection period), up to the time of 6 months after the protection period ends (During 6 months after the due date of the Trademark protection period) by paying the PNBP value of the extension of 2 times the value of PNBP Trademark Extension 6 months before the expiration of the Trademark protection period.

Brands will expire if not renewed

In the event that the mark is not renewed, then the DJKI will give your mark an “Expired” status (see example in the image below). Consequently, an expired mark can be used and registered by another party with a similar name.

Brand Analysis

The Trademark Analysis process is carried out by comparing the Trademark that wants to be registered by comparing it with registered Trademark data in the Intellectual Property Database (PDKI). The trademark is analyzed by taking into account the similarity of the writing elements, images or logos of the trademark, and the pronunciation by also taking into account the type of goods and or services of the registered trademark.

By analyzing the trademark in advance before the trademark is registered, it will save the loss of cost and time if the trademark turns out to be unregistrable.

  • famous marks owned by other parties for non-similar goods and/or services that meet certain requirements; or geographical indications that have been registered.
  • is or resembles the name or abbreviation of a famous person, photograph, or the name of a legal entity owned by another person, except with the written consent of the rightful owner;
  • imitate or resemble the name or abbreviation of the name, flag, emblem or symbol or emblem of a country, or national or international institution, except with the written consent of the authorized party;
  • or is an imitation or resembles an official mark or seal used by the state or a government agency, except with the written consent of the authorized party.

Creative Products Can Be Collateral for Debt/Loan

President Joko Widodo issued Government Regulation Number 24 Year 2022 on Creative Economy.
